Smith Charged In Multiple Counties with Abuse

OSCEOLA — A Rising City man faces charges of sexually abusing his stepdaughter.

Daniel Smith, 37, of Rising City, is being held at the Platte County Detention Center on a $100,000 bond in connection to charges in Polk and Lancaster counties. Smith faces first- and third-degree sexual assault of a child and incest charges in Polk County and first-degree sexual assault and incest charges in Lancaster County.

According to the probable cause affidavit, Smith called Nebraska 988 on Sept. 2 and reported he was suicidal because he was “having a sexual relationship with his stepdaughter.” The stepdaughter, now 20, told officers the alleged incidents began when she was 13 years old. The incidents allegedly occurred when the two were home alone in Osceola and when they were at a hotel in Lincoln while Smith’s wife was in the hospital.

Polk County Sheriff Deputy Brittany McCracken interviewed Smith on Thursday, Oct. 3. According to the affidavit, Smith told McCracken that his wife was leaving him. At first, he denied having a sexual relationship with his stepdaughter. According to court documents, Smith later admitted to the sexual contact with his stepdaughter.

After a 90-minute interview, Smith was placed under arrest.

Smith will be in the Polk County Court on Thursday for a court appearance.
